1. Overview
These Terms and Conditions (“Terms”) are entered into by and between you (“you,” “your,” or “User”) and Okai, Inc., a corporation organized under the laws of the State of California, with its principal place of business at 1458 E Mission Blvd, Pomona, CA 91766, USA (“Okai,” “we,” “us,” or “our”).
These Terms govern your access to and use of the website located at oncamoto.com and its subdomains (the “Site”), and your purchase of ONCAMOTO recreational vehicles and related accessories (the “Product(s)”) offered through the Site (collectively, the “Services”).
By accessing or using the Site, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Site or purchase Products through it.
These Terms are intended for users located in the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.
2. Definitions
• “Product(s)” means the ONCAMOTO vehicle(s) and related accessories offered for sale on the Site.
• “Order” means a request to purchase Product(s) submitted through the Site.
• “Content” means all text, graphics, images, video, and other material appearing on the Site.
3. Eligibility
3.1 You must be at least 18 years old to create an account, place an Order, or enter into a purchase agreement through the Site.
3.2 The Product is intended for operation only by individuals who meet the minimum age, physical, and other requirements stated in the Owner’s Manual and on-Product safety warnings. Purchasing the Product on behalf of a minor does not relieve the purchasing adult of responsibility for the minor’s compliant, supervised use.
3.3 By using the Site, you represent that you have the legal capacity to enter into a binding contract.
4. Modification of Terms
4.1 Right to Modify. We may update these Terms at any time and for any reason at our sole discretion.
4.2 Notice of Material Changes. If we make a material change (for example, a change affecting your rights or increasing your obligations), we will update the “Last Updated” date above and, where you have provided one, notify you by email.
4.3 Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms. If you do not agree, your sole remedy is to stop using the Site.
5. Account Registration
5.1 To place an Order you may be required to create an account. You agree to provide accurate, current, and complete information and to keep it up to date.
5.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at info@oncamoto.com of any unauthorized use.
5.3 We may suspend or terminate your account if you violate these Terms, if we reasonably suspect fraudulent or unlawful use, or as otherwise necessary to protect the Site, other users, or Okai.
6. Orders, Pricing, and Payment
6.1 Order Acceptance. Submitting an Order is an offer to purchase the selected Product(s) subject to these Terms. No contract is formed until we accept your Order (by order-confirmation email or by processing payment). We may refuse or cancel any Order at our discretion, including for pricing errors, suspected fraud, or unavailability.
6.2 Pricing. All prices are stated in U.S. dollars and exclude applicable sales tax, delivery/freight charges, and other fees disclosed before checkout. We may correct pricing errors at any time before an Order is fulfilled.
6.3 Deposits and Pre-Orders. Where the Site permits a deposit or pre-order, the amount, refundability, and estimated fulfillment timeframe will be disclosed at the time of purchase and are incorporated into these Terms.
6.4 Payment. You authorize us (or our payment processor) to charge your selected payment method for the full Order amount, including any deposit, balance, taxes, and shipping charges.
6.5 Orders by Existing Dealers. If you have a valid, signed Master Framework Agreement or similar distributor/dealer agreement with Okai, Inc. (an “MFA”) covering your purchase of Okai or ONCAMOTO products, any Order you place through the Site is deemed a Purchase Order issued under, and is governed by, that MFA. To the extent any provision of these Terms conflicts with your MFA in connection with such an Order, your MFA controls.
7. Shipping and Delivery
7.1 Delivery dates shown on the Site or in your Order confirmation are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, supply availability, or other causes beyond our reasonable control.
7.2 Risk of loss and title to the Product pass to you upon delivery to the carrier or, where applicable, upon delivery to your specified address.
7.3 Please inspect your Product promptly on delivery and report any shipping damage to us within 7 days.
8. Cancellations, Returns, and Refunds
8.1 Order Cancellation. You may cancel an Order before shipment by contacting info@oncamoto.com. Deposits on pre-ordered or custom-configured Products may be non-refundable or subject to a cancellation fee, as disclosed at the time of purchase.
8.2 Returns. You may return an unused, uninstalled, and unregistered Product in its original condition within 30 days of delivery for a refund of the purchase price. Please see our Refund Policy for details:https://oncamoto.com/pages/return-policy
8.3 Non-Returnable Items. Products showing signs of use, operation, or registration; custom or made-to-order configurations; and Products missing original packaging or accessories may not be eligible for return, except as required by law or under warranty.
8.4 Refunds. Approved refunds are issued to your original payment method within 5 business days of our receipt and inspection of the returned Product.
8.5 This Section supplements, and does not replace, any separately published Return Policy on the Site. If a published Return Policy is more favorable to you, it controls to the extent of any conflict.0
9. Product Warranty
9.1 Limited Warranty. The limited warranties applicable to the Products purchased from our Site are detailed in the documentation we provide with the products (the “Limited Warranty”).
9.2 IMPLIED WARRANTIES. TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED IN DURATION TO THE DURATION OF THE LIMITED WARRANTY STATED ABOVE. SOME STATES DO NOT ALLOW LIMITS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY BY STATE, INCLUDING RIGHTS UNDER THE CALIFORNIA SONG-BEVERLY CONSUMER WARRANTY ACT (CAL. CIV. CODE § 1790 ET SEQ.) IF YOU ARE A CALIFORNIA RESIDENT.
9.3 The Limited Warranty does not cover damage from unauthorized modification, use on public roads, use inconsistent with the Owner’s Manual, racing or competitive use unless expressly permitted, accident, abuse, or ordinary wear and tear.
9.4 Nothing in these Terms limits any non-waivable consumer protection available under the law of your state of residence.
10. Important Safety Notice — Off-Road Use Only; Assumption of Risk
10.1 NOT STREET LEGAL. THE PRODUCT IS NOT DESIGNED, MANUFACTURED, CERTIFIED, OR INTENDED FOR USE ON PUBLIC ROADS, HIGHWAYS, OR OTHER PUBLIC RIGHTS-OF-WAY, AND DOES NOT COMPLY WITH U.S. DOT/NHTSA FEDERAL MOTOR VEHICLE SAFETY STANDARDS FOR STREET-LEGAL VEHICLES. THE PRODUCT IS INTENDED SOLELY FOR RECREATIONAL USE ON PRIVATE PROPERTY OR AT DESIGNATED OFF-ROAD FACILITIES, WITH THE PROPERTY OWNER’S PERMISSION AND IN COMPLIANCE WITH ALL APPLICABLE STATE AND LOCAL LAW (INCLUDING, WHERE APPLICABLE, OFF-HIGHWAY-VEHICLE REGISTRATION REQUIREMENTS). OPERATING THE PRODUCT ON A PUBLIC ROAD MAY BE ILLEGAL AND IS ENTIRELY AT YOUR OWN RISK.
10.2 INHERENT RISK. RIDING OR OPERATING THE PRODUCT INVOLVES INHERENT AND SIGNIFICANT RISK, INCLUDING RISK OF SERIOUS INJURY OR DEATH. READ AND FOLLOW ALL WARNINGS, THE OWNER’S MANUAL, AND SAFETY INSTRUCTIONS BEFORE USE, AND WEAR A DOT/CPSC-COMPLIANT HELMET AND APPROPRIATE PROTECTIVE GEAR AT ALL TIMES WHILE OPERATING THE PRODUCT.
10.3 ASSUMPTION OF RISK. BY PURCHASING OR USING THE PRODUCT, YOU ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ITS USE, FORESEEABLE OR NOT, AND AGREE THAT OKAI IS NOT RESPONSIBLE FOR ANY INJURY OR DAMAGE ARISING FROM YOUR OR ANY THIRD PARTY’S USE OF THE PRODUCT, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR BY A DEFECT COVERED UNDER THE LIMITED WARRANTY, AND EXCEPT WHERE SUCH LIABILITY CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
11. Release, Waiver of Liability, and Indemnification
11.1 To the maximum extent permitted by law, you release, waive, and discharge Okai, its affiliates, officers, employees, and licensors from any liability for loss, damage, injury, or death arising out of or related to your purchase, ownership, or use of the Product, except where caused by our gross negligence or willful misconduct or as otherwise prohibited by law.
11.2 You agree to indemnify, defend, and hold harmless Okai from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Product; (b) your violation of these Terms or applicable law; or (c) your violation of any third party’s rights.
11.3 Nothing in this Section limits any right you may have under applicable consumer-protection law that cannot be waived by agreement, including rights under California law regarding strict product liability for a manufacturing or design defect.
12. Limitation of Liability
12.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCAMOTO IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.2 Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. General Use Restrictions
You agree not to:
• use the Site for any unlawful purpose or in violation of these Terms;
• infringe our or any third party’s intellectual property, privacy, or other rights;
• interfere with or disrupt the Site or any servers or networks connected to it;
• attempt to gain unauthorized access to any part of the Site;
• transmit any virus, malicious code, or other harmful technology through the Site;
• scrape, harvest, or collect information about other users without consent; or
• reverse engineer, decompile, or disassemble any software made available through the Site.
14. Intellectual Property
14.1 The Site and its Content (excluding your User Content), including software, designs, text, graphics, images, video, trademarks (including ONCAMOTO, Okai and associated logos), and compilations, are owned by us or our licensors and protected by U.S. and international copyright, trademark, and other intellectual-property laws.
14.2 Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, rent, or create derivative works based on any part of the Site or its Content without our prior written consent.
15. User Content
15.1 Any reviews, comments, photos, or other content you submit to the Site (“User Content”) remains yours, but by submitting it you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, adapt, publish, and display it in connection with operating and promoting the Site and the Products.
15.2 You represent that you own or have the necessary rights to submit your User Content and that it does not infringe any third party’s rights or violate any law. We may remove any User Content at our discretion.
16. Third-Party Links and Services
The Site may link to or integrate services provided by third parties (such as payment processors or shipping carriers). We do not control and are not responsible for the content, accuracy, or practices of any third-party service. Your use of any third-party service is at your own risk and subject to that third party’s terms.
17. Privacy

18. Disclaimer of Warranties (Site)
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
19. Governing Law and Dispute Resolution
19.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.
19.2 Informal Resolution. Before filing a claim, you agree to first contact us at 【info@oncamoto.com】 to attempt to resolve the dispute informally for at least 30 days.
19.3 Any dispute arising out of or relating to these Terms or your purchase or use of the Product shall be exclusively submitted to the courts located in Los Angeles County, California for final resolution through litigation.
20. Miscellaneous
20.1 Entire Agreement. These Terms, together with any Return Policy and Privacy Policy referenced here, constitute the entire agreement between you and us regarding the Site and the Product, and supersede all prior communications.
20.2 Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full force.
20.3 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
20.4 Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control.
20.5 No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
